These Terms of Service (Terms) apply to your use of ewpspares.com.au (Website) and to products and services supplied by EWP Spares Pty Ltd (EWP Spares, we, us or our).

By accessing our Website, creating an account, requesting a quotation, placing an order or purchasing products from us, you agree to these Terms.

EWP Spares supplies parts, components, accessories, diagnostic equipment and other products for elevated work platforms, access equipment and related machinery.

We supply customers in Australia and may also supply customers internationally, including in the United Kingdom and United States.

2. Eligibility to Purchase

You must have the legal capacity to enter into a binding agreement to place an order with EWP Spares.

If you place an order on behalf of a company, business or other organisation, you confirm that you are authorised to place the order and bind that organisation to these Terms.

3. Product Information

We take reasonable care to ensure product descriptions, photographs, part numbers, specifications, compatibility information, pricing and availability shown on our Website are accurate.

However:

  • product images may be for illustration purposes
  • colours, packaging, labels or minor product details may change
  • manufacturers may supersede or replace part numbers
  • specifications may change without notice
  • compatible or replacement parts may differ visually from the original component
  • a product may fit only certain machine models, serial number ranges or configurations.

Where there is a material error in a product listing, we reserve the right to correct it.

If an error affects an order you have already placed, we will contact you and provide an appropriate option, which may include proceeding with corrected information, selecting an alternative product or cancelling and refunding the affected item.

Nothing in this section limits any rights that cannot lawfully be excluded.

4. Genuine OEM, OEM Equivalent and Aftermarket Products

EWP Spares may sell:

  • genuine Original Equipment Manufacturer (OEM) products
  • OEM-equivalent products
  • aftermarket replacement products
  • universal products.

Where reasonably practicable, the product listing will indicate the type of product being supplied.

References to manufacturer names, model names and part numbers may be used to identify compatibility or intended application.

Unless expressly stated that a product is a genuine OEM product, the use of a manufacturer name, model or part number does not mean that the product was manufactured, authorised or endorsed by that manufacturer.

All third-party trademarks remain the property of their respective owners.

5. Compatibility and Part Selection

Many EWP and machinery components vary according to:

  • make
  • model
  • serial number
  • production year
  • machine specification
  • controller generation
  • software version
  • regional configuration.

Customers are responsible for checking that a product is suitable for their intended application before ordering.

We strongly recommend confirming the machine model, serial number and existing part number where applicable.

If you are unsure, contact us before placing your order.

We may request:

  • machine make
  • machine model
  • machine serial number
  • existing component part number
  • photographs
  • controller or software information.

Where EWP Spares expressly confirms compatibility based on information supplied by you, you may rely on that confirmation, subject to the accuracy and completeness of the information you provided.

EWP Spares is not responsible for an incorrect part selection where incorrect, incomplete or misleading machine or component information was supplied to us.

This does not limit rights available under applicable consumer law.

6. Technical Installation

Many products sold by EWP Spares are intended to be installed, inspected, programmed or commissioned by appropriately trained or qualified persons.

Customers are responsible for ensuring that:

  • installation is carried out correctly
  • appropriate safety procedures are followed
  • the machine is isolated where required
  • applicable manufacturer procedures are followed
  • required testing is performed before returning equipment to service
  • applicable workplace, electrical and machinery safety requirements are followed.

Installation instructions or technical information provided by EWP Spares do not replace the relevant manufacturer's service manual, safety instructions or the judgement of a competent technician.

7. Diagnostic, Electronic and Programmable Components

Certain products may include:

  • controllers
  • printed circuit boards
  • displays
  • sensors
  • diagnostic tools
  • analysers
  • software-related components
  • electronic control modules.

Some products may require programming, calibration, configuration or software updates before use.

Compatibility may depend on machine software or hardware configuration.

Unless expressly included in the product description or quotation, programming, calibration, installation and commissioning are not included in the product price.

8. Pricing

Prices are displayed in the currency indicated on the Website.

Australian prices may include or exclude GST depending on the customer type, catalogue and pricing presentation. The applicable GST treatment will be shown at checkout or on your quotation or invoice.

International customers may be shown pricing in another currency through Shopify Markets or another currency conversion service.

Currency conversions displayed on the Website may change according to exchange rates.

We reserve the right to change prices at any time before an order is accepted.

If an obvious pricing error occurs, we may contact you before fulfilling the order. If you do not wish to proceed at the corrected price, we will cancel the affected item and refund any amount paid for it.

9. Trade Accounts

Approved trade customers may receive access to:

  • trade pricing
  • volume pricing
  • account-specific pricing
  • trade-only products
  • backordering
  • other commercial terms.

Trade pricing is confidential to the approved account and must not be shared, distributed or made publicly available without our permission.

Trade account access may be reviewed, changed, suspended or withdrawn where reasonably necessary, including where:

  • account information is inaccurate
  • the account is being misused
  • payment terms are not met
  • trade pricing is being shared improperly
  • there has been fraudulent or abusive activity.

Approval of a trade account does not guarantee credit terms.

Unless expressly approved in writing, orders must be paid for at the time of purchase.

10. Volume Pricing

Certain products may qualify for quantity or volume-based discounts.

Volume discounts:

  • may apply only to specific quantities
  • may vary by customer or product
  • may not be combined with other discounts
  • may be changed for future orders
  • may be subject to available stock or supplier availability.

The price shown at checkout or confirmed in writing by us is the applicable price for that order.

11. Placing an Order

Submitting an order does not necessarily mean that we have accepted it.

An order is accepted when we confirm acceptance or begin processing or dispatching the order.

We may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable
  • there is a pricing or listing error
  • payment cannot be verified
  • fraud or unauthorised activity is suspected
  • shipping to the destination is not reasonably available
  • export, sanctions, safety or legal restrictions prevent supply.

If we cancel a paid order before supply, we will refund the amount paid for the cancelled products.

12. Stock Availability

Stock information displayed on our Website is intended to provide customers with a guide to availability.

Stock levels may change rapidly and errors can occasionally occur.

An item shown as available may become unavailable before an order is processed.

If this occurs, we will contact you with available options.

These may include:

  • waiting for replacement stock
  • placing the item on backorder
  • selecting an alternative product
  • removing the item from the order and receiving a refund.

13. Backorders

Approved products may be available for backorder.

A backorder means the product is not currently available for immediate dispatch but can be ordered for future supply.

Any estimated arrival or dispatch date for a backordered product is an estimate only and may change due to circumstances outside our reasonable control.

If a significant delay occurs, we will provide available options in accordance with applicable law.

14. Special Orders

Products marked Special Order are products that we may order from a supplier specifically to fulfil a customer's order.

Estimated special-order lead times are estimates and may be affected by:

  • manufacturer stock
  • international freight
  • customs processing
  • production schedules
  • public holidays
  • supplier delays.

Unless required by applicable law, special-order products may not be eligible for change-of-mind cancellation or return after we have committed the order to our supplier.

Your rights in relation to faulty, incorrectly supplied or materially misdescribed products are not affected.

15. Payment

Available payment methods will be displayed at checkout or advised on your quotation.

You agree to provide accurate billing and payment information.

Orders may not be dispatched until payment has been received or authorised unless credit terms have been approved in writing.

Where credit terms have been approved, additional account terms may apply.

16. Fraud Prevention

We may carry out reasonable checks to prevent fraud or unauthorised transactions.

We may request additional information to verify:

  • identity
  • payment authority
  • business information
  • shipping information.

We may delay, decline or cancel an order where we reasonably suspect fraudulent or unauthorised activity.

17. Shipping and Delivery

Shipping is governed by our Shipping Policy, which forms part of these Terms.

Delivery dates and transit times are estimates unless we expressly agree otherwise.

Delays may occur due to carriers, weather, customs, supplier issues or circumstances outside our reasonable control.

Nothing in this section removes rights provided by applicable consumer law.

18. International Orders

EWP Spares may accept orders for delivery outside Australia.

International customers are responsible for reviewing whether the products they order can lawfully be imported, installed and used in their destination country.

Unless expressly stated otherwise at checkout or in writing:

  • international freight charges are payable by the customer
  • customs duties may apply
  • import taxes may apply
  • VAT, sales tax or other local taxes may apply
  • customs clearance fees may apply.

Where these charges are not collected by EWP Spares at checkout, they are the responsibility of the recipient.

Refusal to pay applicable import charges does not automatically entitle the customer to a full refund.

Any return, abandonment or disposal costs charged to EWP Spares may, where permitted by law, be deducted from any refund otherwise payable.

19. Import and Local Compliance

Equipment standards and regulatory requirements differ between countries.

Unless we expressly confirm otherwise in writing, EWP Spares does not represent that every product sold through our Australian Website complies with every technical, electrical, environmental, certification or machinery requirement applicable in another country.

International purchasers are responsible for checking local requirements before ordering.

This provision does not limit rights or obligations that cannot lawfully be excluded.

20. Returns and Refunds

Returns, refunds and exchanges are governed by our Returns & Refund Policy, which forms part of these Terms.

Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded.

21. Australian Consumer Law

For customers entitled to protection under the Australian Consumer Law, our goods and services come with statutory consumer guarantees.

These rights operate in addition to any voluntary warranty offered by EWP Spares or a manufacturer.

Nothing in these Terms is intended to exclude, restrict or modify rights or remedies where doing so would be unlawful.

22. Warranties

A product may be covered by:

  • statutory consumer guarantees
  • an EWP Spares warranty
  • a manufacturer's warranty
  • a supplier warranty.

The applicable warranty will depend on the product.

A warranty claim may require us to inspect, test or return the product to the manufacturer or supplier.

Voluntary warranty coverage may not apply to damage resulting from circumstances such as:

  • incorrect installation
  • incorrect programming
  • incorrect voltage
  • misuse
  • abuse
  • impact damage
  • water ingress not attributable to a product defect
  • unauthorised modification
  • use outside the product's intended application
  • failure to follow applicable installation or service procedures.

These exclusions relate to voluntary warranty coverage and do not exclude statutory rights that apply despite them.

23. Returns of Electrical and Electronic Components

Because electrical and electronic components can be damaged by incorrect installation, incorrect voltage, wiring faults, short circuits or incompatible equipment, we may inspect or test these products before approving a warranty claim.

Evidence that a component has been installed does not by itself remove statutory rights in relation to a faulty product.

However, installed, opened or used electrical/electronic components may not qualify for a change-of-mind return under our voluntary returns policy.

24. Technical Information

EWP Spares may provide technical information through:

  • product descriptions
  • our Knowledge Base
  • email
  • telephone support
  • guides
  • diagrams
  • other materials.

Technical information is provided to assist customers and does not replace:

  • OEM service manuals
  • operator manuals
  • workplace procedures
  • regulatory requirements
  • competent technical judgement.

Machine configurations and manufacturer information can change.

Where safety is involved, always confirm information against the applicable manufacturer's documentation before carrying out work.

25. Website Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You must notify us if you believe your account has been accessed without permission.

You must not:

  • impersonate another person
  • use another customer's account without permission
  • attempt to interfere with Website security
  • use automated tools to scrape confidential pricing or account information
  • use the Website for fraudulent or unlawful purposes.

26. Intellectual Property

Content on the Website, including EWP Spares branding, photographs, graphics, original written material and website content, is owned by or licensed to EWP Spares unless otherwise indicated.

You may use Website content for ordinary personal or business purchasing purposes.

You must not reproduce, republish, sell or commercially exploit our original content without permission.

Third-party trademarks, part numbers, diagrams and manufacturer materials remain the property of their respective owners.

27. Third-Party Services

Our Website may use or link to third-party services including:

  • Shopify
  • payment providers
  • freight providers
  • social media platforms
  • analytics services.

Your use of those services may also be subject to their own terms and privacy policies.

28. Liability

Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, EWP Spares is not responsible for indirect or consequential loss arising solely from:

  • incorrect product selection by a customer
  • incorrect installation
  • unauthorised modification
  • use contrary to manufacturer instructions
  • incorrect information supplied by the customer
  • use of a product outside its intended application.

Any limitation in these Terms applies only to the extent permitted by law.

29. Force Majeure and Events Outside Our Control

We are not responsible for delays caused by events outside our reasonable control, such as:

  • natural disasters
  • extreme weather
  • industrial action
  • carrier disruption
  • port congestion
  • customs delays
  • war or civil disturbance
  • government restrictions
  • supplier interruption
  • widespread telecommunications or technology outages.

Where such an event materially affects an order, we will take reasonable steps to keep affected customers informed.

30. Privacy

Our collection and handling of personal information is governed by our Privacy Policy.

31. Changes to These Terms

We may update these Terms from time to time.

Any changes will apply to future use of the Website and future transactions from the date the revised Terms are published.

The Terms applying to an existing order will generally be those in effect when that order was placed, except where a change is required by law.

32. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Nothing in this clause prevents a consumer from relying on mandatory rights available to them under the laws of their country or jurisdiction where those rights cannot lawfully be excluded by contract.
